Uttar Pradesh Government strict on illicit and poisonous liquor

Lucknow: The Uttar Pradesh Government has directed all the Divisional Commissioners, District Magistrates and Commissioner, Excise to strictly enforce provisions of Gangster Act and if necessary the National Security Act (NSA) in cases of loss to human lives, against the persons storing, transporting and selling illicit and poisonous liquor.

In the Government Order issued in this regard to all the Divisional Commissioners and the District Magistrates, the Principal Secretary, Excise, Sanjay R. Bhoosreddy, has directed them that in the cases of loss of human lives due to consumption of illicit and poisonous liquor, action should be taken under Sections-272, 273 and 304 (Culpable homicide not amounting to murder with punishment of Imprisonment for Life or 10 Years and Fine) of Indian Penal Code and also under NSA, in addition to enforcing Section-60 (A) of United Province Excise Act, 1910 (as Amended). Prosecutions should be effectively registered in cases of loss of human lives, disability and serious physical injuries caused by consuming poisonous liquor.

Mr. Bhoosreddy directed the concerning officers to consider registering prosecution under Gangster Act and if necessary also under the NSA against the persons found guilty of indulging again in distilling and smuggling of illicit liquor. He also underlined the need for effective advocacy of the cases through senior prosecution officer/district government advocate before the special court. If special court has not been constituted in any district, its constitution should be ensured immediately through coordination committee.
